Por las dudas te transcribo lo que dice a continuación: Under the Spanish constitution, any Spanish citizen of full legal age is entitled to bring a prosecution charging the accused with an offence; this prosecution runs parallel with that brought in the normal way by the public prosecutor, and the charges made and the punishment sought need not be identical with those contended for by the public prosecutor; the private prosecution may call its own witnesses and examine both them and the witnesses called by either of the parties at the trial, which is held as a single continuous proceeding, it is thus an independent party to the proceedings; in practice, such private prosecutions (no confundir con querellas), are normally confined to cases of large-scale fraud,criminal negligence causing injury or loss, ... etc
